Terms & Conditions

1.) DEPOT HOURS

Monday to Friday: 8-00am to 5-00pm. Saturday & Sunday: 8-00am to 12-00 noon.

All Branches will be closed on Christmas Day, New Years Day and Good Friday.

2.) VEHICLE CHECK IN TIME

Vehicle drop off and pick up must be between 8.00am and 3-00pm weekdays and between 8.00am and 11-00am weekends. Please arrive on Saturday or Sunday at least an hour prior to the depot closing time. Vehicles returned late will be charged a full day rental penalty unless prior arrangements have been made. After hours pick up and drop off can be organised by prior arrangement at a cost of $50-00, payable on pick up or drop off.

3.) 24-HOUR HELPLINE

The operator head office runs a 24-hour, 7 days a week Australia-wide help and information service.

4.) ONE WAY RENTALS

We offer a very simple and inexpensive one way rental scheme. There is a flat charge of $200 for one way rentals between any of our depots. The minimum number of days for a one way rental is four (4) days. Should a hirer have more than one rental (multiple rentals), then each rental is treated as a separate rental under the one way rental conditions.

5.) MINIMUM DAYS RENTAL

The minimum number of rental days for Campervans, Motorhomes and 4 WD's is 4 days.

6.) MULTIPLE RENTALS

Multiple rentals may be combined to qualify the hirer for the longer-term rental rates. Eg. One 12-day rental plus one 9-day rental qualifies for the 21-day rate. The time period between rentals must not exceed one calendar month. Please note, the one way rental fee (if applicable) remains for each rental. The maximum insurance level applies to each individual rental. Multiple Rentals cannot be combined for Full Cover Insurance conditions.

7.) RENTAL TIME EXTENSIONS

Rental Time Extensions or Drop off Location changes are at the discretion of the management and rely entirely on future demand and availability. Any request for an extension MUST be communicated as soon as practicable and possible and must be approved with head office on 1800 684 550. Charges may apply.

8.) EARLY DROP-OFF

There will be no refund for early termination of a rental or hire agreement. If a vehicle is left at any place other than our depots, pick up fees will be charged at $45 per hour for the retrieval of the vehicle. There is no refund available for the unused portion of the rental should the vehicle be returned earlier than contractually agreed.

9.) CANCELLATIONS

Cancellation fees apply as follows:

If cancelled within 30 days of pick-up: $200 / Deposit is non-refundable

If cancelled within 7 days of pick-up: 50% of the total gross hire charges

If cancelled on the day of pick-up or no show: No refund available No commission will be paid on Cancellation fees.

10.) VEHICLE SUBSTITUTIONS

The operator reserves the right to upgrade to a higher rated vehicle at no extra cost.

Should a lower rated vehicle be offered, our responsibility is limited to the refund of the difference in the total gross rate.

11) DAILY HIRE CONDITIONS

The operator calculates the hire of a vehicle on a per calendar day basis within depot hours ie irrespective of what time it is collected or returned within depot hours. When calculating the number of days a vehicle is rented the day of pick-up is counted as the first day of the rental. The day of drop off is counted as the final rental day.

12.) WHERE I WILL RETURN THE VEHICLE

I will return the vehicle to the operator location set out on the rental agreement. I understand that there will be an extra charge of AUD$750 if I return the vehicle to a different location.

13.) DRIVERS

A current motor vehicle driver's licence is required and must be produced on pick up. Should the overseas licence be in a language other than English, it must be accompanied by a current international driving permit which is issued in the country where the licence was issued, or an accredited English translation of that licence.

14) LIMITED KILOMETRE RENTALS

There is a charge of thirty cents (0.30 c) for extra kilometres travelled while renting on a limited kilometre rental. 150 kilometres per day are included in the Daily Hire charges.

15.) UNAUTHORISED AND PROHIBITED USE

Persons who must not drive the vehicle -

a) A person who is not identified on the rental agreement

b) A person whose blood alcohol concentration exceeds the lawful percentage.

c) A person whose driver's licence has been cancelled or suspended.

d) A person who is under the influence of legal or illicit drugs.

All Insurance Cover will be void if above Terms are breached.

16.) DRIVERS AGE

The minimum age for drivers is 23 years. The maximum is 75 years. Exception: Drivers that are between 21 and 23 years carry an additional age excess of $1,500 (on top of the Standard or CDW excess) which is payable on pick-up of the vehicle.

17.) CREDIT CARD TRANSACTIONS

We strongly recommend you bring an internationally recognised credit card. Our preferred Cards are MasterCard and VisaCard. All credit card transactions will be conducted in Australian Dollars.

18.) FINANCIAL OBLIGATIONS

By entering into the rental agreement you authorise the operator to charge the credit card provided or any other credit card provided for your bond / deposit (and you will pay on demand any balance) with the following charges.

a) All rental charges specified on the rental agreement.

b) All charges claimed from the operator in respect of parking or any other traffic violations incurred during the period of the rental.

c) All loss of or damage to the motor vehicle (including loss of use) legal expenses, towing and recovery charges where -

1. You have left the vehicle unlocked or left the keys in the vehicle.

2. You have not kept the key secure and under your personal control.

3. The underbody of the vehicle is damaged regardless of cause when no other vehicle is involved.

4. The vehicle is totally or partially immersed in water regardless of the cause.

5. The interior of the vehicle is damaged regardless of cause.

6. The vehicle is damaged by driving it under or into an object lower than the height of the vehicle.

7. You have failed to maintain all fluid levels or have failed to immediately rectify or report to us any defect of which you become aware.

8. For any damage to the vehicle while in your care regardless of who is in the wrong.

19.) WRITING AND CALCULATION ERRORS ON RENTAL AGREEMENT

The charges as set out herein are not final. Should a writing and/or a calculation error occur, I authorise the operator to charge my credit card for any shortage, or in case of overpayment, receive payment from the operator.

20.) TAXES and CHARGES

A charge of 2% of the total hire charges is levied to cover government taxes and other financial institution charges. 10% GST charge is built into all the operator rates.

21.) GAS

There is a fee for LPG gas: Campervans and 4WD's $15 and Motorhomes $30.

22.) FUEL

The fuel (Diesel / Petrol) tanks in all vehicles are full on pick up and must be full on return by the hirer. The charge for the operator adding fuel will be at pump price plus a handling fee of $45 per hour. If on return the vehicle is found not to be full, the vehicle will be topped up and charged to your credit card.

23.) THE OPERATOR'S LIABILITY

The operator will not be under any liability to the renter for any loss or damage caused through delay in delivery of the vehicle that is caused through accidents or by reason of the vehicle not being as described in the agent brochure, or not being suitable for my (the client's) purposes. The operator will also not be liable for loss of time, change in drop off location or damage through natural disasters such as floods, cyclones, hailstorms etc.

24.) TYRE DAMAGE

Tyres are subject to the clauses of your selected Insurance Cover: CPPP Insurance covers you for two (2) tyres per rental. With CDW and Standard Insurance, you are responsible for all costs associated with tyre repairs (including blowouts and tyre staking).

25.) AGENT NON PAYMENT

In the case of my agents' non-payment of my rental I hereby agree to make the payment for the rental prior to the pick-up of the vehicle. I agree to abide by the Terms and Conditions of the operator and agree to pay for the gross amount of the rental prior to pick-up.

26) MAXIMUM NUMBER OF PASSENGERS

I agree that the vehicle rented may only be used with the maximum number of passengers as is shown on the rental agreement or as dictated by the licensing authorities. The operator will not accept any liability if these Terms are breached.

27) VALUABLES

The operator assumes no liability for valuables left in the vehicle or stolen from the vehicle. Please do not leave valuables in the vehicle because of possible theft. In major cities it is advisable to leave your vehicle in the Caravan Park and take public transport to the city. Please note: Insurance on personal property is your responsibility.

28) TRANSFERS

Transfers to and from the operator are not included in the rental price. It is the client's responsibility to get to and from the operator's depots.

29) CLEANING BOND & RETURN OF VEHICLE

A cleaning bond of $100 is taken on the pick-up of the vehicle. The cleaning bond will be refunded at the completion of the rental provided that the vehicle is returned in the same condition as stated herein. I also acknowledge that having received the vehicle in a clean condition, I agree to pay the operator a cleaning charge if the vehicle is not returned in the same condition. Campervans and Motorhomes fitted with a toilet must have the waste tanks empty on return, otherwise the fee of $150 for toilet waste evacuation will be charged.

30) ANIMALS & PETS

The operator does not allow the carriage of pets or any animals in their vehicles whilst on rental. Carriage of pets or animals will render the contract void, and the rental bond and the cleaning bond will be retained and used for having the vehicle properly cleaned & fumigated.

31) RENTAL REFUSAL

The operator reserves the right to refuse any rental, or continuation of any rental at its discretion

32) REPAIRS

The operator's vehicles are always fully maintained and serviced. This does not stop occasional breakdowns and small problems. Minor repairs to mechanical items and oil consumption up to $50 will be reimbursed against receipts on completion of the rental. Should larger problems be encountered please ring our head office for further assistance. The operator will then approve the repairs if the hirer was not directly responsible for the damage. In all cases the responsibility of the operator is limited to refunding for the time that the vehicle was actually in repair. No alternative accommodation or food items will be paid for during down time. Malfunction of Radio/Cassette players TV's, Videos, Microwave, Stove and Grill, Air-conditioning units, Fridge, Water Pump, Shower and Toilet are not considered mechanical breakdowns and downtime will not be paid for these items. Towing and retrieval of damaged vehicles to the closest operator depot is not covered under Standard Cover and CDW Damage Protection. The cost of the towing or retrieval will be charged to the hirers credit card or deposit / bond held.

33) MAINTENANCE & RESPONSIBILITY

Joint hirers and all drivers are jointly and severally responsible under the rental agreement.

The hirer will be held fully responsible for engine damage if the radiator cap is not properly replaced and sealed on checking fluid levels and / or the warning buzzer for overheating is ignored. All vehicles are fitted with a radiator alarm. The hirer is responsible to check and maintain all fluid and fuel levels and must immediately rectify and / or report to head office any defect of which you become aware. The operator, on presentation of receipts, will reimburse refills of all fluids except petrol and diesel. The hirer shall drive the vehicle in a careful and cautious manner and will not do or allow anything to be done to harm the vehicle. The hirer shall not use the vehicle for anything other than its intended purpose, or allow use of the vehicle to carry passengers or goods for hire. The hirer shall not allow the vehicle to be used to carry volatile liquids, corrosive or inflammable materials or explosives.

34) ROAD RESTRICTIONS – 2WD:

The operator's 2WD vehicles are not allowed to travel on unsealed (dirt or gravel) roads. Travel on these roads voids all damage protection cover that the hirer has selected and paid for. The hirer will be totally liable for all damage should any damage be caused by the hirer of the vehicle while travelling on unsealed (dirt or gravel) roads. The full cost of the damage to all parties concerned may be deducted from the hirer. If in the opinion of the operator a vehicle is found to have travelled on unsealed (dirt or gravel) road the bond / deposit will be retained until the vehicle is fully inspected and checked for damage. If no damage has occurred the bond will be returned to the hirer in full, less the cost of inspection. If any damage is found, refer to the appropriate damage liability in the Standard Cover, CDW or CPPP Damage Protection.

35) ROAD RESTRICTIONS – 4WD:

The operator's 4 WD vehicles may be driven on recognised tracks. 4 WD vehicles may only travel to the following areas with the written permission of the operator: Simpson Desert, Gunbarrel Highway, Cape York, Oodnadatta Track, Birdsville Track, Tanami Track and Gibb River Road. 4WD vehicles are not permitted on: the Canning Stock Route, tracks to & from "The Lost City" in Litchfield Park, "The Old Telegraph Track" in Cape York, between South Alice Creek and the Jardine River. Note: The Jardine River must only be crossed by ferry. Access to Palm Valley is only allowed via Hermannsburg. Travel on the above restricted routes will render all insurance cover invalid and all recovery costs will be borne by the hirer. If the vehicle is fitted with an Emergency Position Indicating Radio Beacon (EPIRB), the hirer is responsible for all costs incurred, if used, including Search & Rescue attempts.

36) LIVING EQUIPMENT

All living equipment, as detailed in the line drawings, is included in the vehicle for use. Any extra equipment requested may be given for use if available and may be collected on pick up. Baby & booster seats are available at $15 per booking and must be booked in advance. Picnic table and 2 chairs are available at $15 per rental and are subject to availability. Extra chairs $8 each per rental. Items must be booked in advance.

37) SINGLE VEHICLE ACCIDENT

Single vehicle accidents carry additional liability dependent on the damage protection package taken. Standard Cover and CDW is an additional $1,500.

38) BOND - DEPOSIT - DAMAGE PROTECTION

There are three types of cover available.

Damage Protection with AU$5,000 excess is called Standard Cover.

Damage Protection with AU$2,000 excess is called CDW.

Damage Protection with AU$750 bond is called CPPP.

39) PAYMENT OF DAMAGE PROTECTION

Payment of the Damage Protection Bond depends on the option selected and is the excess for either the Standard Cover, CDW or CPPP. If Standard Cover Damage Protection is selected, the bond is payable by cash, traveller's Cheques or credit card. The credit card will be processed initially, and refunded on return of the vehicle if all is in accordance with the contract conditions. If CDW or CPPP is selected, a signed, authorised credit card voucher for the appropriate excess / bond must be lodged for the duration, of the rental period. If the vehicle is returned undamaged and in accordance with the contract conditions, the voucher will be returned to the hirer or destroyed and therefore not processed. Standard Cover, CDW and CPPP do NOT cover damage from the vehicle being immersed in water. Any insurance offered by your Credit Card Company for rental vehicles is NOT acceptable by the operator as insurance cover for any rental.

40) DAMAGE COVER

In the event of an accident, personal injury is covered through Registration 3rd Party Insurance. All vehicles are fully insured for own damage and 3rd Party Property Damage, but the renter is responsible for the Damage liability in accordance with the "Damage Protection" that has been selected. All cover is void and cancelled if any of these Terms & Conditions are breached during the period of the rental agreement.

41) EXEMPTIONS

There are no exceptions to the Standard Terms and Conditions of the operator

42) ACCIDENTS

Most accidents occur for the following reasons -

Driving too fast. Driving on the wrong side of the road. Turning across oncoming traffic. Driving while sleepy and tired. Collisions with animals. Whilst reversing the vehicle. Driving while intoxicated. Driving at night.

43) CONTRACTUAL RIGHTS

By signing this Rental Terms and Conditions contract I accept that the terms and conditions make this an Australian Contract and I will be bound by the Australian State Law in which state this agreement is contracted in. This contract overrides any other contract form or contract taken in any other country. Any changes made to this contract must be in writing and signed on behalf of the operator and the client. The operator makes no express or implied warranty in relation to this agreement.

44) TV, VIDEO AND RADIO

TV`s and Radio's in country areas sometimes can only pick up national channels. Please be aware that TV's have to be tuned when moving from one area to another. The responsibility of tuning rests with the renter. It is quite simple to do so ask the depot staff to explain the tuning method.

45) AWNING DAMAGE OR REPLACEMENT COSTS

All costs associated with the full replacement or damage repairs to the awning, where included, shall be borne by the Hirer. The maximum liability is AU$1,000. Awning damage or full replacement is not covered by any of the Damage Protection options of CPPP or CDW

46) PAYMENT IN AUSTRALIA

All payments to be paid in Australia will be in Australian Dollars only. No foreign currency will be accepted.

47) DISCLAIMER

All illustrations, line drawings and text in any of our brochures or advertising material are a representation only of the vehicles depicted. Variances in any vehicles or its equipment offered for rental could occur due to modifications and /or upgrades to vehicle design.

48) EXCHANGE RATE / CURRENCY FLUCTUATION

All credit card transactions are conducted in Australian Dollars. Due to exchange rate fluctuations there could be some variance in the amount initially debited against the credit card and the amount refunded when the vehicle is returned. The operator accepts no liability for these variances, up or down.

49) IMPORTANT

Problems associated with the rental of the vehicle must be reported in writing to the operator during the actual rental or when dropping off the vehicle – we do not accept liability for any claims submitted after this period.

 

For your peace of mind
The operator wants you to make the most of your holiday, and this includes enjoying a worry free motoring holiday. Because of this we provide you with three types of damage protection when you hire our vehicles. Please be aware that some things are different in Australia to other countries, especially in the way of Insurance and the interpretation of the law. There are many people in Australia who own and drive un-insured vehicles. There is no law in Australia requiring people to have insurance against third party property.

In some cases it is impossible to recover money (damages) from un-insured people, even through the Australian Legal System. Personal injury is covered by the Compulsory Third Party insurance with the vehicle registration.

OPTION 1 (Recommended)
COVER "PLUS" PROTECTION PACKAGE (CPPP)

2 Wheel Drive vehicles: $35.00 per day
4 Wheel Drive vehicles: $47.00 per day **(Refer note 6 below)
Why not remove the worry of extra, unexpected costs from your holiday. We consider CPPP a wise investment for worry free motoring whilst on your holiday.

Your Cost: 2 WD - $35 per day (Maximum payable per rental on 2 WD is $1,750)
4 WD - $47 per day (Maximum payable per rental on 4 WD is $2,250)
Multiple bookings cannot be added together to obtain maximum payable.

Your Bond / Deposit: $500.00 (refundable in full on return of vehicle in clean state, fueled up and at Depot as agreed in Rental Contract) Your Bond will be processed on pick up.
Your Damage Liability: $ 500.00

Drivers under the age of 23 years are not eligible for Cover "Plus" (CPPP). If the Terms & Conditions of the contract are broken (such as driving on unsealed roads with 2 WD’s), the Damage Protection (CPPP) is void and you, the hirer of the vehicle, are liable for the full extent of any damage caused. Your Damage Liability applies regardless of how the damage is caused and regardless of who is initially at fault** (Refer note 2 below).
The minimum hire period for 2 wheel drive vehicles to be eligible for CPPP cover is 7 days. CPPP cover is not available for hires less than this period.
The minimum hire period for 4 wheel drive vehicles to be eligible for CPPP cover is 14 days. CPPP cover is not available for hires less than this period.

Items that are NOT covered by CPPP liability include:
Water Damage: Caused by the vehicle being immersed in water (such as creeks, rivers, dams, floods etc)
Theft While Renting: The keys of the vehicle must be secured at all time. The vehicle must remain locked when not in use. Failure to have the vehicle secured if stolen will result in making this damage agreement void
Awnings: Awning damage and replacement

There is a $500.00 excess for the following:
Windscreens
Tyres
Towing & retrieval costs
Overhead Damage
Underbody Damage

OPTION 2
COLLISION DAMAGE WAIVER - (CDW)

2 Wheel Drive vehicles: $25.00 per day
4 Wheel Drive vehicles: $32.00 per day

Collision Damage Waiver covers the vehicle that you have rented against any loss and/or accidental damage in the event of a collision with another vehicle. Damage to the vehicle and other property that you have collided with is covered to the extent of $10 million.

Your Cost: $25 per day on 2WD’s (Maximum Payable per rental is $1,250)
$32 per day on 4 WD’s (Maximum Payable per rental is $ 1,500)
Multiple bookings cannot be added together to obtain maximum payable.

Your Bond / Deposit: $2,000 (refundable in full on return of undamaged vehicle) ** (refer Note 1below)
Your Damage Liability: $2,000 or part thereof if the damage is assessed less than $2,000 ** (refer Note 2 below)
Single vehicle accidents carry an additional liability of $1,500 (making a total cost of $3,500). Please refer to ** (Note 3 below). Plus any towing & retrieval costs to the closest depot. Drivers under the age of 23 years carry an additional liability (deposit) of $1,500 making a total of $3,500 (Please refer to ** (Note 4 below)

Drivers must still be over the age of 21 years to qualify.

If the Terms & Conditions of the contract are broken (such as driving on unsealed roads with 2 WD’s), the Damage Protection (CDW) is void and the renter is liable for the full extent of any damage caused. Damage Liability applies for the full extent of any damage caused and regardless of who is initially at fault ** (refer Note 2 below)

CDW does NOT cover
Windscreens: You are responsible for all costs associated with full windscreen replacements and repairs when damaged including cracks & star chips.
Tyres: You are also responsible for all costs associated with tyre repairs, whether caused by blowouts and punctures, sidewall damage (often caused by road edges) and tyre staking (sticks or suicidal echidnas etc).
Overhead Damage: Any damage above the drip-rail or to the fibreglass roof caused by driving under trees, low awnings etc.
Underbody Damage: Caused by driving over tree stumps, rocks, objects on the road or driving on unsealed roads.
Single Vehicle Accident: These accidents carry an additional liability of $1,500 making your total liability $3,500, PLUS any overhead damage, underbody damage and towing & retrieval costs.
Towing & retrieval costs: Salvage & towing costs from accidents, misuse or abuse of the vehicle are not covered by CDW. In the case of a badly damaged vehicle involved in an accident, the towing will be to the closest depot.
Water Damage: Caused by the vehicle being immersed in water (such as creeks, rivers, dams, floods etc)
Awning Damage or Replacement.

POTENTIAL LIABILITY
The potential liability based on our previous experience, for the following damage repairs are:

Windscreens - $260 Overhead Damage $3,500
Tyres - Campervans $125 Underbody Damage $1,400
Tyres - Motorhomes $225 Towing & Retrieval $1,000
Tyres – 4WD $145 Awning $1,000

OPTION 3
COLLISION DAMAGE $5,000 EXCESS

The third choice is not to take any damage protection offered in Option 1 & Option 2. This is considered to be an extremely risky choice as if you are involved in an accident, you are responsible for up to $5,000 for each & every claim, plus the additional $1,500 for a single vehicle accident if applicable.

This is the minimum cover available on all rentals from the operator

All the conditions that apply under CDW (Collision Damage Waiver) apply if this cover is taken except the Damage liability payable.

Note 1:
Bond/Deposit Return. If the vehicle is returned with any damage, or has been involved in an accident, whether the fault of the renter or not, the bond will be retained by the operator until the full cost of the damage is determined, or the claim has been settled by the Third Party's Insurance Company. The Bond will then be returned to the renter in full if it is determined that there is no liability to the third party under Australian Motor Vehicle Laws & with Australian litigation. Please note that Third Party claims can take months or even years to resolve. The operator cannot force the destiny of these claims, it is up to our Insurance Company and the Third Party, may they be insured or not.

Note 2: Bond/Deposit Return. (Partial Return) If the vehicle is returned with damage that is of an undetermined repair cost, the full bond will be retained by the operator until the full cost of repair has been established. Only then will the unused portion, if any, of the bond (the difference between the bond that was retained and the actual repair cost) be refunded to the client. This may take up to six weeks to establish & complete. In the case of a third party involved the time taken could be six months.

Note 3: Bond/Deposit Return. Single Vehicle Accident Single vehicle accidents are defined as any damage that is done to the vehicle where no other vehicle is involved, or where the accident is with another vehicle, but you cannot provide the operator with the driver's licence, name or the registration number of the other vehicle. Examples of single vehicle accidents include such things as running into trees, guideposts or animals, whether intentionally or not, whilst travelling forward or reversing. Collision with animals are considered to be a single vehicle accident, as too is overturning the vehicle, or any other damage done to the vehicle for any reason where there was not another vehicle directly involved.

Note 4: Drivers under 23 years. Proposed drivers that are under the age of 23 years on pick-up of the vehicle are unable to take CPPP Damage Protection. These drivers may qualify to drive at the discretion of the management of the operator if they are over the age of 21 years on the day of pick up. These drivers will incur an additional bond of $1,500 (bringing their Bond to a total of $3,500 for CDW or $6,500 for Collision Damage - Option 3) which will become the excess if there is any damage done to the vehicle.

Note 5: Liability limits will apply for each accident, dependent on the Damage Protection chosen. A new bond will need to be lodged after each accident.

Note 6: 4WD Rentals: CPPP Protection is not available on 4WD Rentals travelling on the Gibb River Road and to Cape York. The hirer will be liable in case of an accident up to A$ 2,000. In case of a single vehicle accident the hirer will be liable for an additional A$1,500. The total liability will be A$3,500.


I, the Renter or Hirer hereby understand & agree that a credit card imprint will be taken on pick-up of the vehicle (under CDW Insurance) by the operator and held until the return of the vehicle. Under Collision Damage - Option 3, the Bond taken, by whatever means, will be processed (banked). On return of the vehicle, if there has been no damage caused, I understand that I will receive the credit card imprint back or be refunded the appropriate Bond that was lodged. The operator is not responsible for currency fluctuations on bonds taken by Credit Card.

I also understand that if there is any damage, the credit card imprint will be lodged for the appropriate excess (including Single Vehicle liability if applicable) and that this is duly authorised by myself. I authorise the operator to deduct from my credit card any other liability that is in excess of the Bond held. (Eg. Underbody or overhead damage).
